The following Gift Card Terms and Conditions (this "Agreement") describe the terms and conditions that apply to all Gift Cards (collectively, "Digital Goods") purchased from KALEOZ.
1. General
1.1 By using a Gift Card purchased from KALEOZ (referred to as the "Digital Goods"), you agree to these Digital Goods Terms in addition to the User Agreement for the KALEOZ website, which is incorporated herein by reference.
1.2 In the event of any conflict between these Digital Goods Terms and the User Agreement, the provisions of these Digital Goods Terms will prevail.
1.3 You should review the product description of the Digital Goods for any specific terms, conditions, or expiry dates set by the Seller or merchant. KALEOZ does not assume responsibility for such Seller- or merchant-specific terms.
2. Responsibility for Digital Goods
Title to the Digital Goods and the risk of loss, destruction, or deterioration shall pass to you upon purchase.
You assume full responsibility for the Digital Goods, including any associated PIN codes.
KALEOZ shall not be liable or responsible for Digital Goods that are lost, stolen, destroyed, or used without your permission.
3. Redeeming Digital Goods
3.1 After completing your purchase, the redemption code for your Digital Goods will be displayed on the purchase confirmation page. Locate the Retrieve button and click it to obtain your code. Make sure you copy or note down the code accurately.
3.2 To redeem your Digital Goods, visit the designated website or platform specified for the product. This may be a specific URL provided by the retailer, publisher, or merchant where the redemption process takes place.
3.3 If you encounter any issues during the redemption process, such as the code not working or the item not appearing in your account, please contact customer support for assistance.
4. Customer Responsibilities
You acknowledge and agree to the following:
4.1 Digital Goods must be redeemed within the time frame specified in the product description.
4.2 Digital Goods must not be used in a manner that disrupts or negatively impacts other users or services provided by KALEOZ.
4.3 Digital Goods are provided "as is" without guarantees. KALEOZ does not warrant the quality, accuracy, or fitness for a particular purpose of the Digital Goods beyond what is explicitly stated in the product description.
4.4 Using a Digital Good indicates your acceptance of these Digital Goods Terms.
4.5 KALEOZ disclaims all warranties, whether express or implied, regarding the Digital Goods, including, but not limited to, their accuracy, completeness, merchantability, or fitness for a particular purpose.
4.6 To the maximum extent permitted by law, KALEOZ excludes all implied warranties and remedies.
5. Refunds, Exchanges, and Cancellations
5.1 Digital Goods cannot be returned, refunded, or canceled by the Customer after purchase.
5.2 Exchanges of products or services purchased using Digital Goods are subject to the Seller's terms and conditions. KALEOZ does not facilitate or manage such exchanges and bears no responsibility for the outcome of exchange requests between Customers and Sellers.
5.3 KALEOZ reserves the right to cancel or reject any Digital Goods if fraudulent activity is suspected.
6. Availability
6.1 KALEOZ does not guarantee the performance or reliability of its website.
6.2 KALEOZ may, at its sole discretion, suspend or discontinue the availability of Digital Goods without prior notice or liability.
7. Data Use and Disclosure
7.1 You agree that KALEOZ may use or disclose your information in accordance with the KALEOZ Privacy Policy. You may withdraw your consent by following the procedure outlined by KALEOZ.
7.2 Order fulfillment for Digital Goods may be managed by the Seller, and you may receive PIN codes directly from the Seller. KALEOZ requires all Sellers to comply with applicable data protection laws and regulations when handling your information.
8. Miscellaneous
8.1 The rights and protections provided to KALEOZ under these Digital Goods Terms are additional to those provided under the User Agreement and Privacy Policy.
8.2 If any provision of these Digital Goods Terms, the User Agreement, or the Privacy Policy is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable to the fullest extent permitted by law.
8.3 KALEOZ reserves the right to modify these Digital Goods Terms at any time. Continued use of Digital Goods after any changes indicates acceptance of the updated terms.
9. Limitation of Liability
KALEOZ makes no representations or warranties of any kind, express or implied, regarding the Digital Goods. To the fullest extent permitted by applicable law, KALEOZ expressly disclaims all warranties, including warranties of merchantability, quality, title, and fitness for a particular purpose.
In no event shall KALEOZ, its officers, directors, employees, or agents be liable for any special, incidental, indirect, consequential, or punitive damages, including damages arising from loss of use, data, or profits, however caused and regardless of the theory of liability, arising out of or in connection with this Agreement, even if KALEOZ has been advised of the possibility of such damages.
KALEOZ's aggregate liability, whether arising from breach of contract, tort, or any other legal theory, shall not exceed the amount paid by you for the relevant Digital Goods and/or the product or service most closely related to your damages.
The foregoing limitations apply even if any warranty or remedy provided under this Agreement fails to fulfill its essential purpose.
Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages or other limitations set forth above. Therefore, some of these limitations or exclusions may not apply to you.
Without prejudice to the foregoing and to the fullest extent permitted by law, KALEOZ shall have no liability to you if the Digital Goods infringe or are alleged to infringe any rights, including intellectual property rights, of any third party.
10. Law and Dispute Resolution
You agree that the laws of Malaysia, without regard to principles of conflict of laws, shall govern this Agreement and any dispute of any sort that may arise between you and KALEOZ in connection with this Agreement or any Digital Goods.
